Redfern-Waterloo Street Team Enterprise AgreementNancy assisted affiliates in negotiating an Enterprise Agreement with the Premier’s Department for the newly established Redfern/Waterloo Street Team. The Street Team is a trial of a partnership between Government and Non-Government Organisations to better the lives of the Community of the Redfern and Waterloo area. The Enterprise Agreement was approved by the Industrial Relations Commission of NSW, resulting in workers in Government and non-Government agencies working alongside each other under one industrial instrument. Ethical Clothing Trades CouncilNancy continued in her role with the Ethical
Clothing Trades Council where she was greatly assisted by the TCFUA. The Council delivered its report to
the Minister, with the report being tabled in Parliament during the week
commencing 1 December 2003. The Council made a recommendation, supported by the
Australian Retailers Association, that a mandatory Code of Practice be
introduced for any retailer who has not signed or complied with the current
voluntary Code. ReebokNancy assisted TCFUA in having Reebok sign a Deed relating to its supply and manufacture of clothing and footwear in Australia, particularly items of clothing for the Rugby World Cup 2003. The Deed ensures ethical practices in the manufacture of Reebock’s products and allows the Union to ensure ethical practices are maintained by allowing the Union’s officers access to supply chain details. Transfer Of Parking Patrol OfficersIn 2002 Nancy was involved with the USU
in the transfer of the functions of Parking Patrol Officers from the New South Wales Police
Service to Local Government. Nancy filed complaints with the
Anti-Discrimination Board (ADB) in respect of two parking patrol officers and in
2003 both matters were successfully resolved. One through conciliation at the
ADB and the other through proceedings before Her Honour Justice Kavanagh in the
Industrial Relations Commission of NSW. HSU and WSAHS – Workplace SurveillanceNancy intervened in proceedings in the Industrial Relations taken by the HSU against Western Sydney Area Health Service for the unfair dismissal of a number of their members and the inappropriate use of the Workplace Video Surveillance Act. Nancy made submissions on behalf of the Labor Council before His Honour Deputy President Sams in relation to a breach of the Workplace Video Surveillance Act by the Western Sydney Area Health Service. His Honour’s decision is expected in the New Year. Secure Employment Test CaseNancy assisted Deputy Assistant Secretary Chris Christodoulou with the preparation of the Labor Council’s Secure Employment Test Case. Nancy assisted Chris in briefing MP’s on the Labor Council’s case and seeking their support. Nancy assisted with obtaining evidence and will continue to assist Chris with the preparation of hearing of the matter. As a result of the Labor Council’s test case, Nancy intervened on behalf of the Labor Council in a dispute notified by the Australasian Meat Industry Employees Union Newcastle and Northern Branch against Sunnybrand Chickens Byron Bay. Sunnybrand Chickens attempted to contract out its chicken boning work by way of independent contracts. This case is continuing before the Industrial Relations Commission of NSW and Nancy will continue to be involved and make submissions on behalf of the Labor Council when the matter is arbitrated early in 2004. Public Sector GuidelinesNancy assumed an oversight role in the negotiation of the Public Sector Guidelines, particularly with regard to their interaction with the Labor Council’s Secure Employment Test Case. Union DuesNancy continued to assist affiliates seeking to have the Union Dues Clause inserted into awards where employers were resisting on the basis that the clause is not test case standard. To date, all unions seeking to have the Clause inserted have been successful in doing so, but as a ‘Consent Variation” to their Awards rather than a Test Case Standard. Spokeswomen NetworkNancy continued to represent the Labor Council on panel discussions at Spokeswomen training sessions run by the Department for Women. Nancy and Deputy Assistant Secretary Alison Peters have alternated in attending these conferences during 2003. This arrangement has worked well for the Labor Council and for the Spokeswomen’s Network. ASU Services and the RSLNancy intervened on behalf of the Labor Council in a dispute notified by the ASU Services Branch against the RSL relating to the classification structure and Award Coverage of Welfare Officers employed by the RSL. The dispute is yet to be finalised before Commission O’Neill in the Industrial Relations Commission of NSW and Nancy will continue her involvement on behalf of the Labor Council.
