Labour Hire: Some Controversies

The disputes over identity of the employer and the obligations of the parties in employment relationships are highlighted in various cases, the NSW Taskforce report and the current Victorian govt inquiry.

This paper looks at the rise of labour hire, provides a definition of what it is, and looks at cases where the identity of the employer has been considered and the concept of joint employment. Occupational health and safety issues are a major issue and the responsibility of the various parties is a grey area.
