Impact of WorkChoices On the Family Provisions Test Case Standards

The right to request enhanced parental leave provisions and the obligation on employers to consult with employees on parental leave about significant changes in the workplace affecting their position have not been enacted in WorkChoices

This is one aspect of the 2005 Family Provisions decision of the AIRC that has not been included in the new legislation.

Awards that have been varied to include the new AIRC standard, prior to WorkChoices, will continue in force.
